1. Acceptance of Terms

Welcome to Zuldeira Technologies LLC ("Zuldeira," "we," "us," or "our"). By accessing or using our website at zuldeira.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site.

These Terms constitute a legally binding agreement between you ("you" or "user") and Zuldeira Technologies LLC. We reserve the right to modify these Terms at any time. Your continued use of the Site following any modifications constitutes acceptance of the updated Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
  • Transmit any advertising, promotional materials, spam, or other forms of unsolicited communication
  • Impersonate or attempt to impersonate Zuldeira, a Zuldeira employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, servers, or databases connected to the Site
  • Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
  • Use any automated system, including bots, scrapers, or spiders, to access the Site without our express written permission

3. Intellectual Property

The Site and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement — are owned by Zuldeira Technologies LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Zuldeira name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Zuldeira Technologies LLC. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans appearing on the Site are the trademarks of their respective owners.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site except as generally and ordinarily permitted through the Site according to these Terms.

4. SMS Communications

By opting in to receive SMS messages from Zuldeira Technologies LLC through our SMS Consent page or contact form, you agree to the following:

  • You will receive text messages related to inquiry follow-ups and, if opted in, product updates from Zuldeira Technologies LLC
  • Message frequency will not exceed 1 message per month
  • Message and data rates may apply based on your mobile carrier's plan
  • You may opt out at any time by replying STOP to any message
  • You may request assistance by replying HELP to any message
  • Consent to receive SMS messages is not a condition of purchasing any goods or services

We will not share your phone number or SMS opt-in consent data with any third parties or affiliates for their marketing purposes. SMS data collected is used exclusively for the purpose of delivering the communications you have consented to receive.

5. Zuldeira Studios — AI Voice Agent SMS Program

Program Name: Zuldeira Studios AI Voice Agent — Appointment Confirmation

Program Description: When Zuldeira Studios' AI Voice Agent books an appointment on behalf of a salon, the caller may receive a single SMS text message confirming the details of their appointment (date, time, service, and salon name). This service is provided by Zuldeira Technologies LLC.

5a. Consent

SMS appointment confirmations are sent only after the caller provides explicit verbal consent during the phone call with our AI Voice Agent. The AI agent will ask the caller for permission before sending any text message. If the caller declines, no message will be sent. Consent to receive SMS messages is not a condition of receiving any service.

5b. Message Frequency & Content

  • Frequency: One (1) message per appointment booked. No additional messages, no recurring messages, no promotional content
  • Content: Appointment confirmation details only — date, time, service, and salon name
  • Message and data rates may apply based on your mobile carrier's plan

5c. Opt-Out & Help

  • You may opt out at any time by replying STOP to any message. You will receive a confirmation that you have been unsubscribed and will receive no further messages
  • You may request help at any time by replying HELP to any message. You will receive a reply with support contact information
  • You may also decline consent when asked during the phone call

5d. Data Use & Sharing

We will not share your phone number, SMS opt-in consent data, or any information collected through the AI Voice Agent SMS program with any third parties or affiliates for their marketing purposes. Phone numbers collected are used exclusively for delivering the appointment confirmation you consented to receive.

6. User Submissions

When you submit information through our contact form, SMS consent form, or any other submission method on the Site, you grant Zuldeira Technologies LLC a non-exclusive, royalty-free, perpetual, and irrevocable right to use the content of your inquiry (excluding personal identifiers) for the purpose of improving our services and responding to your request.

You represent and warrant that any information you submit is accurate, complete, and not misleading, and that you have the right to provide such information.

7. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by Zuldeira Technologies LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Zuldeira Technologies LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ZULDEIRA TECHNOLOGIES LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZULDEIRA TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to, use of, or inability to access or use the Site
  • Any conduct or content of any third party on the Site
  • Any content obtained from the Site
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE EXCEED THE AMOUNT YOU HAVE PAID TO ZULDEIRA TECHNOLOGIES LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Zuldeira Technologies LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Site
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including any copyright, property, or privacy right
  • Any claim that your submission caused damage to a third party

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction and venue of such courts.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, Studios Privacy Policy, and SMS Consent Terms, constitute the entire agreement between you and Zuldeira Technologies LLC with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we do, we will revise the "Effective Date" at the top of this page. Material changes will be indicated prominently on the Site. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
